Terms of Service

Klovera is operated by Internet Mastery, 1733 Avenida Del Sol, Boca Raton, FL 33432, United States ("we", "us", "our"). These terms apply to the Klovera website at klovera.ai, the Klovera application at app.klovera.ai, the Klovera apps for Shopify, and Klovera's connections to eBay and other platforms (together, "the service"). By creating an account, installing a Klovera app or using the service, you agree to these terms.

1. The service

Klovera generates video, images, voice and text from what you provide, such as a product link, an idea, a script, photos or a voice recording. It also gives you tools to write, cast, render, cut, caption and publish short-form video, and to place that video on your eBay listings and Shopify products. The service relies on third-party AI models and platforms. We choose them, and we may change them as better ones become available. Features and formats may change as the product develops.

2. Accounts

• You must be at least 18 and able to enter into a contract.
• You are responsible for everything done under your account, including by anyone you invite to a workspace. Keep your sign-in details to yourself, and tell us promptly at [email protected] if you think someone has used your account without permission.
• When you install a Klovera app on a Shopify store, we create a Klovera account for that store automatically. That account belongs to the store, and the store owner accepts these terms for it.

3. Free trial

• New accounts may receive a free trial, currently 30 days with 100 credits. The trial's length, credits and included features are shown when you sign up or install. We may change them for new accounts at any time.
• Trial credits end when the trial ends and have no cash value. Each person, business and Shopify store may use one free trial. Uninstalling and reinstalling an app, or opening new accounts, does not start a new trial.
• Connecting eBay, Shopify and social accounts, and publishing to them, requires a paid plan unless the plan or offer shown to you says otherwise.

4. Plans, credits and payment

• Plans. Each paid plan includes a monthly allowance of credits and the features listed on our pricing page or Shopify App Store listing when you subscribe.
• Plan credits reset at the start of each billing month, including on annual plans, and do not roll over. They end when your plan ends. Plan credits are used before purchased credits.
• Purchased credits (credit packs) do not expire and stay yours if your plan ends, as long as your account stays open.
• What credits pay for. Rendering, images, voice and other generation use credits. Every render is a real render and uses credits, including takes you decide not to use. The estimated cost is shown before you start a render. Video is charged for its finished length.
• Failed renders. If a render fails because of the service, its credits are returned to your account automatically.
• Prices are in US dollars and do not include taxes that apply to you. We may change prices. Changes take effect from your next billing period after we tell you.
• How you pay. If you subscribe on klovera.ai, our payment processor handles payment, and we do not store full card details. If you use a Klovera app for Shopify, all charges for that store are billed by Shopify through your Shopify invoice, under Shopify's billing terms.
• Cancelling. You can cancel at any time: on klovera.ai from Billing, or for Shopify by changing your plan or uninstalling the app. Cancellation takes effect at the end of the billing period you have paid for, and you keep access until then.
• Refunds. Payments for plans and credits are non-refundable, as set out in our Refund Policy, except where the law requires otherwise. We do not pro-rate partial months.

5. Your content

"Your content" is what you upload or provide, such as product links and data, images, photos, scripts, voice recordings and brand assets. You keep ownership of it. You give us the license we need to store it, process it and run the service for you, including sending it to the third-party providers that produce your renders and to the platforms you choose to publish to.

You confirm that you have the rights to everything you provide, and that using it with the service does not infringe anyone's rights. If you upload a photo or likeness of a person, or create or clone a voice, you confirm that you have that person's permission.

6. What you make

As between you and us, you own the videos, images, audio and text the service produces for you, once they are paid for. You may use them commercially, including in paid ads, on listings, on product pages and on social media, without crediting us. This depends on your having the rights to the inputs you used.

Generated output is not unique to you. Similar inputs can produce similar results for other users, and we make no promise that any output is original or protectable as intellectual property.

We may use anonymized information about how the service is used to operate and improve it. We do not publish your videos as examples without your permission.

7. Connections to eBay, Shopify and other platforms

• When you connect a platform, you authorize us to act on your behalf within the permissions you grant. On eBay, that can include publishing a video and a new listing description. On Shopify, it can include adding videos and video fields to your products. Nothing is published to your eBay listing until you press Publish. On Shopify, videos are added to a product only when you choose to add them.
• Before Klovera changes an eBay listing description, it saves a copy of the original. Restore puts it back. Your use of eBay, Shopify, Instagram, TikTok, YouTube and other platforms is governed by their own terms, and you are responsible for complying with them, including their rules on listings, ads and AI-generated content.
• Each plan has a limit on how many listings or products can have Klovera videos and pages at once, as shown on the pricing page. Using Restore or taking a video off frees the slot.
• You can disconnect a platform at any time. Third-party platforms can change or withdraw their services, and we are not responsible for their availability or actions.

8. Acceptable use

You may not use the service to create, publish or distribute:

• content showing a real person, including a public figure, without their permission, or in a way that suggests they said or did something they did not;
• sexual content of any kind involving anyone, real or generated, who is or appears to be under 18;
• sexual or intimate content of a real, identifiable person without their consent;
• content that impersonates a person, business or public body in order to deceive;
• testimonials or reviews presented as coming from real customers who did not give them, or claims about health, finances or results that you cannot substantiate or that break advertising law or the rules of the platform you publish to;
• harassment, hate speech, threats, or content that breaks the law where you or your audience are.

You may not try to get around credit limits, trials or plan limits, reverse-engineer the service, or use it to build a competing model or dataset.

We may remove content and suspend or close accounts that break this section. Where we reasonably can, we will tell you why.

9. AI-generated content and advertising

Output from the service is generated by AI. Some platforms and laws require AI-generated or synthetic media, or paid endorsements, to be disclosed. You are responsible for making any disclosure that applies to you and for the ads and listings you run. We do not review your campaigns or listings for compliance.

10. Availability and support

We work to keep the service running but cannot promise it will always be available or error-free. Renders depend on third-party providers and can queue or fail. If a render fails through the service's fault, its credits are returned. Support is available at [email protected] and klovera.ai/support. We aim to reply within two business days.

11. Copyright complaints

If you believe content made or hosted through the service infringes your copyright, email [email protected] with:

• the work you own;
• where the infringing content is;
• your contact details;
• a statement that you believe in good faith the use is not authorized and that your notice is accurate.

We will review the notice and remove content where appropriate.

12. Disclaimers and limit of liability

The service is provided "as is" and "as available". To the fullest extent the law allows:

• we exclude all implied warranties, including merchantability, fitness for a particular purpose and non-infringement;
• we do not promise any sales, views, conversions or other results from videos made with the service;
• we are not liable for lost profits, revenue, data or goodwill, or for indirect, incidental, special or consequential loss;
• our total liability to you in any twelve-month period is limited to the amount you paid us in that period.

Nothing in these terms excludes liability that cannot lawfully be excluded.

13. Indemnity

You agree to defend and indemnify us against claims, losses and costs, including reasonable legal fees, that arise from your content, your ads or listings, your use of connected platforms, or your breach of these terms.

14. Ending your account

You can close your account at any time from Settings or by contacting support. If you use a Klovera app for Shopify, you can uninstall it at any time. We may suspend or close an account that breaks these terms, or where the law requires it.

When an account closes, you lose access to the service and to any remaining plan credits, so download anything you want to keep first. Data is handled as described in our Privacy Policy. For a Shopify store, the store's data is deleted when Shopify asks us to delete it, 48 hours after uninstalling.

15. Changes to these terms

We may update these terms. If a change is material, we will tell account holders by email or in the application before it takes effect. If you keep using the service after that, you accept the change. The date at the top shows when these terms last changed.

16. Governing law

These terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. The state and federal courts located in Palm Beach County, Florida have exclusive jurisdiction, and you and we agree to their jurisdiction.

17. General

These terms, together with our Privacy Policy and Refund Policy, are the whole agreement between you and us about the service. If any part is found unenforceable, the rest still applies. If we do not enforce a right, we have not given it up. You may not transfer these terms without our consent. We may transfer them as part of a reorganization, merger or sale.
